5. Placing an order

5.5 We reserve the right to refuse or reject any Order placed by you at any time (even after we have sent you an Order Confirmation). We will not be liable to you or any third party for cancelling or rejecting an Order.
5.6 If we cancel your Order after we have received payment (and even after we have sent an Order Confirmation), the payment for the Order will be refunded to you in full.
6. Payment
6.1 You may pay for Products using a Payment Intermediary listed on our Website.
6.2 You can also pay for your Order in whole or in part with a discount voucher provided by us. Promotional vouchers can only be entered online at checkout.
6.3 We may use payment intermediaries to process payments between you and us. You agree that we may provide documents and information about you to the Payment Intermediaries, including documents and information containing your personal data.
6.4 We are not a regulated payment processor or money transfer agent and are not responsible for payment problems or disruptions caused by payment intermediaries.
6.5 You are responsible for providing complete and accurate information in the payment process and any payments must be made using your own funds. By placing an order you confirm that:
(a) the payment method used to make the payment belongs to you;
(b) if applicable, you are the rightful holder of the promotional voucher; and
(c) you have sufficient funds or credit facilities to pay for the relevant Order.

7. Delivery
7.1 We will endeavour to deliver your Order to the Delivery Address you provided when placing your Order.
7.2 When you checkout your order, we will provide an estimated delivery date.
7.3 We may notify you if we expect that we will not be able to meet the estimated delivery date but we will not be liable to you for any loss, liability, costs, damages, charges or expenses arising out of late delivery to the fullest extent permitted by law.
7.4 We may not be able to deliver Products to some locations. In this case, we will notify you and arrange for the cancellation and refund of the Order or delivery of the Order to an alternative delivery address confirmed by you.

8. Cancellation or modification of orders
8.1 Once an Order has been placed via our Website, you can cancel or change your Order by sending us an e-mail. Provided that we have been able to process your e-mail in time. We cannot guarantee that we can cancel your order. We work with automated systems. Also, busy times play a role in this. We are not responsible for the cancellation process and will do our best to process it in time.
8.2 Once an Order has been packaged, it cannot be cancelled or amended and must instead be returned to us in accordance with paragraph 10 below. As our goods are shipped from Asia, there may be longer transit times over which we have no control. If the products are already in transit to you, cancellation is not possible. 8.3 Since we work with a fully automated system, orders are processed immediately after placement. Therefore, we unfortunately cannot interrupt the shipping process until delivery, so that a refund before receipt of the goods is only possible up to 24 hours after placing an order.
9. Defective products
9.1 You acknowledge that the Products are of standard quality and are not tailored to meet any specific requirements you may have.

(c) If your item arrives defective, damaged, or non-functional upon delivery, please contact us within 7 days of receiving the product. The customer must provide a photo or video as evidence of the defect along with a description of the issue. Additional evidence may be requested if necessary.
9.9 If we determine that the Product is not defective, we may, at our sole discretion, refuse to provide you with a refund for the Product and may require you to pay all reasonable maintenance costs and charge this to the payment method used to place the Order. We will not be liable to you for any loss, liability, costs, damages, charges or expenses arising under this paragraph to the fullest extent permitted by law.
10. Returns and Refunds
10.1 Our Returns Policy forms part of these Terms and Conditions under which you may access and use our Website.
If you want to return a product due to withdrawal, the return costs are at your own expense. In the event that we have delivered an incorrect or defective item, we will bear the return costs, provided that the defect has been confirmed.
To claim a defect, you must send a clear video of the problem to our customer service. If the defect cannot be confirmed via the video, we may ask you to return the product for a physical inspection. If the defect is recognized after inspection, we will reimburse the return costs. If the defect is not confirmed, the return costs are at your expense.

17.12 In determining whether other parties may be liable to you, no account shall be taken of your inability to bring legal remedies against another party because remedies against that party have become time-barred, or the party's lack of remedies or the party's reliance on any exclusions or limitations of liability or the fact that the other party has ceased to exist.
17.13 The exclusions and limitations of liability in these Terms and Conditions shall not affect our liability
(a) for death or personal injury resulting from our negligence;
(b) for fraud or reckless disregard of professional duty;
(c) for any other liability which cannot be excluded or limited in the jurisdiction to which a relevant claim is subject, including any limitations on our right to limit our liability and
(d) in any other case, to limit our liability to less than the minimum amount which may be required in the circumstances under any other law or regulation relevant to the claim, in which case that minimum amount shall be deemed to be in lieu of the amount that would otherwise apply.
17.14 These provisions are exhaustive of the remedies of monetary damages of either party or any third party against either party arising out of or in connection with these Terms and Conditions.
18. Indemnification
18.1 You shall on demand fully indemnify and keep fully indemnified the Indemnified Parties from and against all claims, costs and losses of whatever nature which the Indemnified Parties may suffer or incur arising out of or in connection with:
(a) any material breach of the provisions of these Terms and Conditions by you;
(b) any fraud, negligence, misconduct or reckless neglect in or relating to your obligations under these Terms and Conditions; and
(c) your use of our Website.
18.2 We shall be entitled to recover from you all out-of-pocket costs reasonably incurred by us in connection with any indemnified claim, and all such costs shall be payable on demand.
19. Event of force majeure
19.1 Indien een geval van overmacht langer dan een week duurt, kunnen wij de Algemene Voorwaarden onmiddellijk beëindigen door middel van een schriftelijke kennisgeving en zonder enige aansprakelijkheid anders dan een terugbetaling van het reeds door u betaalde en nog niet geleverde Product.
19.2 Wij behouden ons absolute discretie voor ten aanzien van de oplossing die wij kiezen om onze verplichtingen onder deze Algemene Voorwaarden volledig na te komen indien zich een geval van Overmacht voordoet.
20. Variaties
20.1 Wij kunnen deze Algemene Voorwaarden van tijd tot tijd wijzigen. Wij zullen u vooraf op de hoogte stellen van belangrijke wijzigingen die volgens ons nadelige gevolgen voor u kunnen hebben. Wij zullen u op de hoogte stellen van alle wijzigingen in deze Algemene Voorwaarden. De Algemene Voorwaarden die van tijd tot tijd van kracht zijn, zijn van toepassing op uw gebruik van onze Website en alle Producten die via onze Website worden aangeboden.
20.2 Als u niet akkoord gaat met herziene Algemene Voorwaarden, moet u stoppen met het gebruik van onze Website of het kopen van onze Producten.
20.3 Als u uw uitdrukkelijke instemming en goedkeuring hebt gegeven aan deze Voorwaarden, zullen wij u om uw uitdrukkelijke instemming en goedkeuring vragen voor eventuele herzieningen van deze Voorwaarden vóór uw eerste aankoop van Producten nadat de herziening van kracht is geworden. Als u niet binnen een door ons aangegeven periode uw uitdrukkelijke instemming met de herziene Voorwaarden hebt gegeven, dient u het gebruik van de Website of de aankoop van onze Producten te staken.
21. Uw inbreuk
21.1 Onverminderd onze andere rechten onder deze Algemene Voorwaarden, kunnen wij, als u deze Algemene Voorwaarden op enigerlei wijze schendt, of als wij redelijkerwijs vermoeden dat u deze Algemene Voorwaarden op enigerlei wijze hebt geschonden:
(a) u een of meer formele waarschuwingen sturen;
(b) uw toegang tot onze Website tijdelijk opschorten
(c) stoppen met het verwerken van een Bestelling
(d) weigeren om enige betaling van u te ontvangen
(e) u permanent de toegang tot onze Website ontzeggen
(f) computers met uw IP-adres de toegang tot onze Website ontzeggen
(g) contact op te nemen met één of meerdere van uw internet service providers en hen te verzoeken uw toegang tot onze Website te blokkeren; of
(h) juridische stappen tegen u ondernemen, hetzij voor contractbreuk of anderszins.
21.2 Als wij uw toegang tot onze Website of een deel van onze Website opschorten, verbieden of blokkeren, mag u geen actie ondernemen om die opschorting, dat verbod of die blokkering te omzeilen.
22. Beëindiging en opschorting
22.1 U kunt het gebruik van de Website op elk moment stopzetten.
22.2 Wij kunnen de levering van de Website op elk moment opschorten, met of zonder reden, en met of zonder kennisgeving.
22.3 Onverminderd paragraaf 22.2 kunnen wij uw toegang tot deze Website opschorten of beëindigen indien uw gebruik van de Website wettelijke aansprakelijkheid van welke aard dan ook veroorzaakt of dreigt te veroorzaken, of anderszins het gebruik van de Website door anderen verstoort.
22.4 Indien wij uw toegang tot de Website opschorten of beëindigen, zullen wij proberen u hiervan vooraf op de hoogte te stellen. Niettemin kunnen wij, naar eigen goeddunken, uw toegang tot de Website onmiddellijk opschorten of beëindigen zonder voorafgaande kennisgeving.
22.5 Wij garanderen niet dat onze Website altijd beschikbaar zal zijn of ononderbroken zal werken. Wij kunnen de beschikbaarheid van onze Website geheel of gedeeltelijk stopzetten, opschorten of intrekken of beperken om zakelijke of operationele redenen. Wij zullen proberen u redelijkerwijs op de hoogte te stellen van een opschorting of intrekking. U zult geen recht hebben op enige compensatie of andere betaling bij de stopzetting, opschorting, intrekking of wijziging van de Website.
23. Gevolgen van beëindiging
23.1 Bij beëindiging van deze Algemene Voorwaarden zal elke verplichting tot het verlenen van klantondersteuning onmiddellijk eindigen.
23.2 U zult onder geen enkele omstandigheid enige aanspraak jegens ons kunnen doen gelden op vergoeding van verlies van rechten, verlies van goodwill of welke andere schade dan ook bij beëindiging van deze Algemene Voorwaarden om welke reden dan ook.
23.3 De beëindiging van deze Algemene Voorwaarden doet geen afbreuk aan enig ander recht dat reeds is ontstaan en zal geen invloed hebben op de bepalingen van deze Algemene Voorwaarden die, overeenkomstig de bepalingen daarvan, uitdrukkelijk zijn bedoeld om daarna van kracht te worden of te blijven. De paragrafen 17 (Aansprakelijkheid) en 18 (Vrijwaring) blijven ook na beëindiging van deze Algemene Voorwaarden van kracht.
24. Algemene bepalingen
24.1 U mag geen van uw rechten onder deze Algemene Voorwaarden overdragen.
24.2 De rechten, bevoegdheden en rechtsmiddelen voorzien in deze Voorwaarden zijn (tenzij uitdrukkelijk anders bepaald) cumulatief en niet exclusief van enige rechten, bevoegdheden en rechtsmiddelen voorzien door de wet, of anderszins.
24.3 Wij besteden de hosting van de Website uit aan een derde partij.
24.4 Indien de geldigheid of de afdwingbaarheid van een bepaling van deze Algemene Voorwaarden op enigerlei wijze wordt beperkt door toepasselijk recht, zal die bepaling geldig en afdwingbaar zijn voor zover toegestaan door dat recht. De ongeldigheid of niet-afdwingbaarheid van een dergelijke bepaling heeft geen invloed op de geldigheid of afdwingbaarheid van enige andere bepaling.
24.5 Het niet of met vertraging uitoefenen van een recht, bevoegdheid of rechtsmiddel waarin deze Algemene Voorwaarden of de wet voorzien, vormt geen verklaring van afstand van dat recht, die bevoegdheid of dat rechtsmiddel. Indien wij afstand doen van een schending van een bepaling van deze Algemene Voorwaarden, geldt dit niet als afstandsverklaring van een volgende schending van die bepaling, of als afstandsverklaring van een schending van een andere bepaling.
24.6 De uitoefening van de rechten van de partijen onder deze Algemene Voorwaarden is niet afhankelijk van de toestemming van een derde partij.
24.7 Deze Algemene Voorwaarden zijn in ons voordeel en in uw voordeel, en zijn niet bedoeld om ten goede te komen aan of afdwingbaar te zijn door een derde partij.
25. Toepasselijk recht
25.1 Deze Algemene Voorwaarden, hun onderwerp en hun totstandkoming (en alle niet-contractuele geschillen of vorderingen) worden beheerst door en geïnterpreteerd in overeenstemming met de wetten van China.
25.2 Elk geschil, controverse, verschil of claim (met inbegrip van niet-contractuele geschillen of claims) voortvloeiend uit of verband houdend met deze Algemene Voorwaarden, met inbegrip van het bestaan, de geldigheid, de interpretatie, de uitvoering, de schending of de beëindiging ervan of elk geschil betreffende niet-contractuele verplichtingen voortvloeiend uit of verband houdend met deze Algemene Voorwaarden, zal worden verwezen naar en uiteindelijk worden beslecht door arbitrage die wordt beheerd door China dat van kracht is op het moment dat de Arbitrageaankondiging wordt ingediend. Het recht dat op deze arbitrageclausule van toepassing is, is het Chinese recht. De plaats van arbitrage is China. Het aantal arbiters bedraagt één. De arbitrageprocedure wordt in het Engels gevoerd.
26. Bemiddelingsvoorwaarden (selectief)
Beschrijving van de bedrijfsstructuur.
Goederen die worden aangeboden op www.Hutsen.nl worden expliciet niet verkocht door
Hutsen. De aangeboden goederen worden verkocht door de Verkoper (bedrijfsnaam
buitenlands bedrijf invoeren). Dit houdt in dat het koopcontract tot stand komt tussen de Koper en
Verkoper. Hutsen wordt op geen enkele manier partij bij deze overeenkomsten.
Hutsen biedt enkel en alleen een bemiddelingsplatform aan.
De algemene voorwaarden die van toepassing zijn tussen Verkoper en Koper zijn aan het einde
van dit document opgenomen. Nota bene: deze algemene voorwaarden zijn van toepassing tussen
Koper en Verkoper en daarom niet inroepbaar jegens Websitehouder.
Indien de Verkoper is gevestigd in een land binnen de EU ofwel Noorwegen, Liechtenstein of
IJsland is de Europese richtlijn “kopen op afstand” van toepassing op de gesloten
overeenkomsten. Alle in deze richtlijn genoemde rechten en garanties zijn derhalve van
toepassing.
Bemiddelingsvoorwaarden
Artikel 1 – definities
In deze bemiddelingsvoorwaarden wordt verstaan onder:
- Website: www.Hutsen.nl. Dit betreft het ter beschikking gestelde platform. Hieronder worden
tevens verstaan alle sub domeinen.
- Websitehouder: de onderneming Hutsen die gevestigd is Hong Kong, en geregistreerd in Hong Kong
- Koper: degene die via bovengenoemde website een aankoop doet bij de Verkoper.
- Verkoper: de buitenlandse onderneming die, hetzij als fabrikant, hetzij als leverancier, goederen
verkoopt aan Koper.

Artikel 2 – De rechten van de Koper
Indien de Verkoper is gevestigd in een land binnen de EU ofwel Noorwegen, Liechtenstein of
IJsland is de Europese richtlijn “kopen op afstand” van toepassing op de gesloten
overeenkomsten. Alle in deze richtlijn genoemde rechten en garanties zijn derhalve van
toepassing, onder andere:
- Verkoper dient Koper informatie inzake belasting, betalingen, leveringen en uitvoering van de
overeenkomst duidelijk en schriftelijk binnen een redelijke termijn te verstrekken.
- Koper ontvangt bestelling binnen 30 dagen, tenzij een andere termijn is overeengekomen. In het
geval dat een product niet (meer) leverbaar is dient Verkoper Koper hiervan op de hoogte te
stellen. Eventuele (aan)betalingen moeten binnen de termijn van dertig dagen teruggestort te
worden op de rekening van Koper, tenzij Verkoper een vergelijkbaar product levert.
- Koper heeft minimaal veertien dagen het recht op herroeping, dit houdt in dat Koper zonder
opgaaf van redenen de koop terug kan draaien. Eventueel gemaakte verzendkosten komen in
deze situatie voor rekening van Koper. Eventuele (aan)betalingen dienen binnen dertig dagen
teruggestort te worden op een door de koper aan te wijzen bankrekening.
Artikel 3 – De bemiddelingsdienst
- Het aanbod van de goederen op Website wordt niet verkocht door Websitehouder. Deze
goederen worden verkocht door Verkoper. Bij aankoop van de goederen wordt derhalve een
koopovereenkomst gesloten tussen Koper en Verkoper.
- De goederen worden via Website verkocht door Verkoper.
- De websitehouder levert een bemiddelingsdienst aan Verkoper. Bij bestelling van de goederen
via de Website, is Websitehouder gemachtigd als bemiddelaar, in naam van Koper en voor
rekening van Koper. De websitehouder is derhalve gemachtigd onder naam van de verkoper te
bestellen bij Verkoper.
- Verkoper is gevestigd buiten Nederland, hierdoor worden de betreffende goederen ingevoerd,
dit gebeurt altijd onder naam van Koper. Bijkomende kosten, zoals invoer-btw en
(douane)inklaringskosten komen eveneens voor rekening van Koper.
- Betalingen aan Websitehouder geschieden enkel en alleen op grond van het aanbieden en
onderhouden van het bemiddelingsplatform.
Artikel 4 – Financiële afhandeling
- De betaling van het aangekochte product verloopt via de websitehouder, de verkoopprijs wordt
na inhouding van de vooraf vastgestelde bemiddeling fee doorgestort aan de Verkoper.
- Verkoper bepaalt welke prijzen worden gehanteerd op de Website.
- Verkoper betaald per verkocht product een vast bedrag aan Websitehouder. Dit bedrag wordt in
een andere overeenkomst vastgesteld en ziet alleen op het aanbieden en onderhouden van het
bemiddelingsplatform.
Artikel 5 – Klachten
1 Koper kan eventuele klachten inzake de uitvoering van de overeenkomst kenbaar maken
aan de Verkoper.
2 Op elke klacht die Verkoper ontvangt zal de Verkoper binnen veertien dagen antwoorden.
3 Koper kan zich bij ontevredenheid over de in lid 1 van dit artikel genoemde procedure
wenden tot de geschillencommissie van het Europees ODR Platform
(https://ec.europa.eu/consumers/odr/).
27. Interpretatie
26.1 In deze Algemene Voorwaarden:
“Contract” betekent uw bestelling van een Product of Producten in overeenstemming met deze Algemene Voorwaarden, die wij aanvaarden in overeenstemming met paragraaf 4.3;
"Klant" betekent iedere persoon die een Bestelling op de Website plaatst;
"Afleveradres" betekent het leveringsadres zoals vermeld in de betreffende Bestelling;
"Geschatte leveringsdatum" betekent een geschatte leveringsdatum van een Bestelling;
"Gebeurtenis van overmacht" elke gebeurtenis of stand van zaken die leidt tot of het gevolg is van een tekortkoming of vertraging voor ons in de nakoming van enige verplichting onder deze Algemene Voorwaarden die wordt veroorzaakt of het gevolg is van een oorzaak buiten onze macht die niet te wijten was, of in belangrijke mate toe te schrijven was, aan enig verzuim van ons om gepaste zorgvuldigheid te betrachten om een dergelijke tekortkoming of vertraging te voorkomen, en oorlog of oorlogsdreiging omvat; een daad van God; natuur- of kernramp; oproer of burgerlijke onlusten; pandemie; terroristische daad; kwaadwillige schade; brand of overstroming; naleving van een nieuwe wet of bevel van een overheidsinstantie of gerechtelijke autoriteit; sluiting van luchthavens of havens; of een handelsgeschil dat niets te maken heeft met de partij die getroffen wordt door de gebeurtenis of stand van zaken die de stopzetting of vertraging van het werk veroorzaakt;
“Indemnified Parties” means us, each of our affiliated companies and their respective officers, employees, contractors and agents. “Intellectual Property Rights” means all intellectual property rights, including patents, trademarks, design rights, copyright, database rights, trade secrets and all rights of a similar nature;
“Order” means the order submitted by you via our Website to purchase a Product or Products from us;
“Order Confirmation” means our email to you confirming your Order in accordance with paragraph 4.3;
“Payment Intermediary” means a third party payment processing service provider used by us;
“Product” means a product offered on our Website;
“Website” means the website;
“Website Infrastructure” means all of our systems (including code) that facilitate, provide or describe the Website;
26.2 References to “sections” are to sections of these Terms and Conditions.
26.3 Headings are for convenience only and shall not affect the interpretation or construction of these Terms.
26.4 Words indicating the singular include the plural and vice versa. Words indicating gender include any gender and references to persons include an individual, company, firm, firm or partnership.
